These Terms and Conditions (“Terms”) govern your access to and use of the Empower Your Results website, products, programs, services, digital materials, sessions, and related offerings.

Empower Your Results is operated by Stephanie Kord Miller (“Company,” “we,” “us,” or “our”) in the Commonwealth of Massachusetts.

By accessing this website, purchasing a product, registering for a session, booking a service, joining a group session, or entering into a paid engagement with Empower Your Results, you agree to these Terms.

If you do not agree to these Terms, please do not use our website, purchase our products, register for our sessions, or participate in our services.

1. Definitions

For purposes of these Terms:

“Client” means a person or business entity that purchases or participates in a paid Empower Your Results service, program, session, or engagement.

“Participant” means a person who attends a live session, group session, workshop, Connection Lab, event, or community-based experience.

“User” means any visitor to the website or person who accesses free or paid materials.

“Services” means coaching, advisory, diagnostic, facilitation, group sessions, strategy sessions, intensives, digital products, templates, downloads, content, and related offerings provided by Empower Your Results.

2. Services Offered

Empower Your Results provides business advisory, operational strategy, coaching, diagnostic, facilitation, and educational services. Current offerings may include the following.

2.1 Business OS Diagnostic

The Business OS Diagnostic is a single diagnostic session designed to identify founder patterns, operational constraints, decision bottlenecks, and practical next steps.

The Diagnostic is a standalone session. It does not create an ongoing coaching, advisory, consulting, or implementation relationship unless separately agreed in writing.

2.2 Business OS Advisory

Business OS Advisory is a package of six advisory and coaching sessions delivered over a period of up to twelve months, unless otherwise agreed in writing.

Sessions are conducted by video conference unless otherwise agreed. All sessions must be used within twelve months of purchase. Unused sessions expire at the end of the twelve-month period and are not subject to refund.

Extensions may be granted at the Company’s sole discretion in cases of illness, emergency, or other extenuating circumstances.

2.3 Business Roadmap Intensive

The Business Roadmap Intensive is a deep-dive strategic planning engagement designed to clarify priorities, align team direction, and build an executable roadmap.

The format, duration, deliverables, payment terms, refund terms, and scope will be outlined in a separate engagement agreement or service confirmation at the time of booking.

Unless expressly stated in writing, the Business Roadmap Intensive does not include ongoing implementation support, project management, technical setup, copywriting, hiring support, software configuration, or ongoing advisory services.

2.4 Connection Lab

Connection Lab is a live, facilitated group working session associated with The Founders Guild and/or related community or collaboration platforms.

By registering for or attending Connection Lab, you acknowledge and agree that:

Connection Lab sessions may be recorded.

Notice of recording may be provided in the registration materials, meeting invitation, platform notice, and/or verbally at the start of the session.

Connection Lab is not a confidential or NDA-protected environment.

You should not share proprietary, sensitive, private, or confidential business information that you are not comfortable discussing in a group setting or having recorded.

Registration may create an account or membership profile within The Founders Guild or a related platform.

You may receive communications associated with your registration, participation, or membership.

If you do not wish to appear on camera, you may keep your camera off, remain muted, and adjust your display name where the platform allows.

Participation after notice of recording constitutes consent to recording.

Empower Your Results may use recordings, transcripts, anonymized themes, de-identified excerpts, and general learnings from Connection Lab sessions for educational, marketing, and content creation purposes.

Empower Your Results will not use your name, business name, image, likeness, or identifying testimonial-style statement in promotional materials without additional written approval.

2.5 Downloadable Products and Templates

Empower Your Results may offer digital products, including templates, frameworks, worksheets, assessments, guides, and other downloadable resources.

All digital product sales are final once accessed or downloaded, except where required by law. Digital products are provided for your internal business use only and may not be copied, distributed, shared, resold, taught from, licensed, or repackaged without written permission.

3. Payment Terms

3.1 General Payment Policy

All fees are quoted and charged in United States Dollars. Payment is required in full at the time of booking or purchase unless a payment plan has been expressly agreed in writing.

Empower Your Results accepts payment through third-party payment processors, including Stripe or other authorized platforms. By submitting payment, you authorize the charge to your designated payment method.

3.2 Payment Plans

Payment plans may be available for the Business Roadmap Intensive or other services at the Company’s discretion and only when expressly agreed in writing.

Payment plans require a valid payment method on file and are processed automatically according to the agreed schedule.

Payment plans are a convenience for paying the full engagement fee over time. They are not subscriptions and do not create a right to cancel remaining payments once the engagement has begun, unless otherwise stated in the applicable engagement agreement.

3.3 Failed Payments

If a scheduled payment fails, the Company may pause or suspend service delivery until payment is resolved.

Repeated failed payments may result in cancellation of the engagement without refund of amounts already paid. The Client remains responsible for any unpaid amounts due under the applicable agreement or payment plan.

3.4 Chargebacks and Payment Disputes

Before initiating a chargeback or payment dispute, you agree to contact Empower Your Results so we can attempt to resolve the issue in good faith.

Improper or unsupported chargebacks may result in suspension of services, cancellation of access, or termination of the engagement.

4. Refund Policy

4.1 Business OS Diagnostic

Business OS Diagnostic purchases are final and non-refundable, except where required by law or expressly agreed in writing by Empower Your Results.

By completing your purchase, you acknowledge that you have reviewed the session description, understand the nature of the service, and agree to the refund and cancellation terms disclosed at checkout.

4.2 Business OS Advisory

Business OS Advisory is a significant advisory investment and is subject to the following refund terms.

No refund will be issued after the first session has been completed, except under the limited exception below.

Limited Refund Exception: If a Client completes the first session and, within forty-eight hours of that session’s conclusion, notifies the Company in writing that they do not wish to continue the engagement, the Company will retain the value of the completed first session and administrative costs, currently $500, and refund the remaining balance paid.

This exception is available one time only, applies exclusively to the first session, and must be exercised in writing within the forty-eight-hour window. No refund will be issued after this window has passed, except where required by law.

4.3 Business Roadmap Intensive

Refund eligibility for the Business Roadmap Intensive will be stated in the engagement agreement or service confirmation provided at the time of booking.

In the absence of a separate written agreement, payments made toward the Business Roadmap Intensive are non-refundable once the engagement has commenced, except where required by law.

4.4 Connection Lab

Connection Lab registration fees, if applicable, are non-refundable except where required by law.

If you are unable to attend a scheduled session, please contact us in advance. Where available, we may make reasonable efforts to provide access to a recording, but access is not guaranteed unless expressly stated in the registration materials.

4.5 Downloadable Products

All sales of downloadable products and templates are final once accessed or downloaded, except where required by law.

5. Scheduling, Cancellations, and No-Shows

Sessions must be scheduled through the Company’s designated booking system or by written agreement.

Cancellations made more than forty-eight hours before a scheduled session may be rescheduled without penalty.

Cancellations made within forty-eight hours of a scheduled session may result in forfeiture of that session.

No-shows, meaning failure to attend a scheduled session without prior notice, will result in forfeiture of that session.

The Company reserves the right to reschedule sessions due to illness, emergency, platform issues, or circumstances beyond our control. In such cases, no session will be forfeited, and rescheduling will be prioritized.

6. Client Responsibilities

You are responsible for showing up prepared, participating in good faith, providing accurate and timely information, making your own business decisions, and implementing any actions you choose to take.

Empower Your Results provides frameworks, perspective, diagnosis, advisory support, facilitation, and strategic guidance. We do not execute business decisions for you unless expressly stated in a separate written agreement.

You remain solely responsible for your business decisions, implementation, financial choices, hiring decisions, legal compliance, tax matters, team management, and outcomes.

7. Professional Advice Disclaimer

Empower Your Results provides business advisory, coaching, facilitation, and strategic guidance services.

Nothing provided through the website, sessions, materials, communications, group experiences, digital products, or services constitutes legal, financial, tax, accounting, investment, employment, medical, mental health, or other licensed professional advice.

You are responsible for consulting qualified professionals before making decisions that require specialized professional guidance.

8. Results Disclaimer

Empower Your Results does not guarantee specific business outcomes, revenue results, profitability, productivity gains, hiring outcomes, performance improvements, or personal results.

Business results are inherently variable and depend on many factors, including your participation, implementation, market conditions, team dynamics, timing, available resources, and business model.

No statement made on the website, in marketing materials, in testimonials, in case studies, or during any session constitutes a guarantee of future results.

Testimonials and case studies represent individual experiences and are not promises that you will achieve the same or similar results.

9. Confidentiality

9.1 Individual Client Sessions

Empower Your Results treats the content of individual coaching, advisory, and diagnostic sessions as confidential. We will not disclose specific details of your individual sessions to third parties without your consent, except as required by law or as necessary to protect legal rights, safety, or the integrity of our services.

9.2 Anonymized Themes and Learnings

You acknowledge that the Company may draw upon general themes, patterns, lessons, and anonymized insights from client work to create educational content, articles, frameworks, talks, workshops, and other materials.

Any such use will be anonymized and will not identify you, your business, or specific details that could reasonably be attributed to you without your written permission.

9.3 Case Studies and Testimonials

The Company may invite you to participate in a case study, testimonial, or success story. Participation is voluntary.

No case study, testimonial, identifying story, or named result will be published without your prior written consent. You will have the opportunity to review and approve identifying content before publication.

9.4 Group Sessions and Connection Lab

Group sessions, workshops, community sessions, and Connection Lab sessions are not confidential or NDA-protected unless expressly stated in writing.

Do not share proprietary, sensitive, private, or confidential business information in group settings unless you are comfortable doing so.

9.5 Client Obligations

You agree to keep confidential any proprietary frameworks, methods, tools, worksheets, templates, strategy materials, recordings, or other materials provided by Empower Your Results.

You may not reproduce, distribute, teach from, share, resell, license, or publicly display Empower Your Results materials without express written permission.

10. Use of Artificial Intelligence Tools

Empower Your Results is an AI-enabled business. We may use artificial intelligence tools, including but not limited to OpenAI, Anthropic, and related AI-supported platforms, to support business operations, session preparation, transcript processing, summarization, content drafting, planning, and follow-up materials.

By engaging with our services, you acknowledge and agree that:

AI tools may be used to support session preparation, transcript processing, summary creation, content drafting, operational workflows, and related business functions.

Information shared during sessions may be processed using third-party AI-supported platforms, subject to those providers’ privacy policies, data processing terms, and security practices.

The Company takes reasonable steps to limit, anonymize, or protect sensitive information when using AI tools, but no third-party platform can be guaranteed to be completely secure.

The use of AI tools does not replace the Company’s judgment, advisory role, or responsibility for the quality of services delivered.

If you do not want your session recordings, transcripts, notes, or business information processed through third-party AI tools, you must notify the Company in writing before your session or engagement begins. In that case, the Company may limit or modify certain follow-up materials, summaries, or deliverables.

You are responsible for not sharing highly sensitive, regulated, confidential, or legally privileged information unless you have first discussed appropriate handling with the Company.

11. Data and Privacy

Empower Your Results collects and processes personal information as described in our Privacy Policy.

Data may include contact information, scheduling information, payment-related information, session information, recordings, transcripts, communications, website usage information, and information submitted through forms, assessments, downloads, or community registrations.

We use third-party service providers to operate our business and deliver services, including payment processors, scheduling tools, video conferencing platforms, CRM and email systems, community platforms, analytics tools, and AI-supported tools.

12. Intellectual Property

All content on the Empower Your Results website and all materials provided in connection with our services are the intellectual property of Stephanie Kord Miller and Empower Your Results, unless otherwise stated.

This includes but is not limited to frameworks, templates, worksheets, assessments, guides, recordings, slide decks, written content, diagnostic tools, advisory methods, educational materials, and business processes.

You may use materials provided to you solely for your own internal business purposes. You may not reproduce, distribute, teach from, train AI models on, resell, license, publicly share, or create derivative commercial products from Empower Your Results materials without express written permission.

13. Acceptable Use

You agree not to misuse the website, services, community spaces, downloads, or materials provided by Empower Your Results.

Prohibited uses include but are not limited to:

Attempting unauthorized access to systems, accounts, or platforms.

Interfering with website, payment, booking, or platform operations.

Uploading malicious code or harmful files.

Scraping, copying, harvesting, or extracting content or data.

Impersonating another person or business.

Posting unlawful, abusive, defamatory, harassing, discriminatory, or infringing content.

Using Company materials to train AI models or build competing products without written permission.

Sharing login credentials or paid materials with unauthorized users.

Using the services or materials for unlawful purposes.

Empower Your Results reserves the right to remove content, suspend access, terminate participation, refuse service, or cancel an engagement where we reasonably believe these Terms have been violated.

14. Third-Party Platforms and Links

Our services may rely on third-party platforms, including scheduling tools, payment processors, video conferencing platforms, CRM and email systems, community platforms, analytics tools, and AI-supported tools.

We are not responsible for interruptions, outages, data practices, policy changes, or service failures by third-party providers.

The website may contain links to third-party websites or resources. These links are provided for convenience only. We do not control and are not responsible for third-party content, policies, or practices.

15. Accessibility

Empower Your Results is committed to making its website and digital materials accessible and usable. If you experience difficulty accessing any part of the website, forms, downloads, videos, or materials, please contact us at [email protected] and we will make reasonable efforts to assist you.

16. Copyright and DMCA

All website content and Company materials are protected by copyright and other intellectual property laws.

If you believe content on our website infringes your copyright, please contact us at [email protected] with your name, contact information, identification of the copyrighted work, the URL or description of the allegedly infringing material, and a statement that you believe in good faith that the use is unauthorized.

Empower Your Results reserves the right to remove allegedly infringing content and to terminate access for repeat infringers where applicable.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Empower Your Results and Stephanie Kord Miller shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the website, services, products, materials, sessions, group experiences, or third-party platforms.

This includes but is not limited to lost profits, lost revenue, loss of business opportunity, business interruption, data loss, reputational harm, or implementation failure, even if advised of the possibility of such damages.

The Company’s total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount you paid to the Company in the twelve months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnification

You agree to indemnify and hold harmless Empower Your Results, Stephanie Kord Miller, and any contractors, affiliates, partners, or representatives from and against claims, damages, losses, liabilities, costs, and expenses arising from your violation of these Terms, misuse of the services or materials, infringement of intellectual property rights, or unlawful conduct.

19. Force Majeure

The Company is not liable for delays or failure to perform due to events beyond its reasonable control, including illness, emergencies, natural disasters, severe weather, labor disruptions, internet outages, platform outages, cybersecurity events, acts of government, or other circumstances beyond reasonable control.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms or your engagement with Empower Your Results shall first be submitted to good-faith informal resolution. If the dispute is not resolved, the parties agree to attempt good-faith mediation.

If mediation is unsuccessful, disputes shall be resolved through binding arbitration in Suffolk County, Massachusetts, in accordance with the rules of the American Arbitration Association, unless another forum is required by applicable law.

Either party may bring an individual claim in small claims court where permitted by law.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Empower Your Results, to the fullest extent permitted by law.

21. Modifications to These Terms

Empower Your Results may update or modify these Terms at any time.

Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the website, services, products, or materials after changes are posted constitutes acceptance of the revised Terms.
